By accessing this website or booking services with Absolute Aerials, LLC (“Absolute Aerials,” “we,” “us,” or “our”), you agree to the following Terms of Service.

1. Services Provided

Absolute Aerials provides professional aerial photography and videography services, including drone operations for real estate, land, marine, and marketing purposes. All services are subject to weather, airspace availability, and safety considerations.

All drone operations are conducted by an FAA-certificated Remote Pilot in accordance with 14 CFR Part 107 regulations.

2. Client Responsibilities

By booking services, the client represents and warrants that they:

Are the property owner or an authorized agent of the owner
Have legal authority to permit aerial imaging of the property
Have obtained any required permissions for property access, takeoff, and landing areas
Will disclose known hazards, restrictions, or sensitive areas prior to the flight

Absolute Aerials is not responsible for disputes arising from unauthorized property access or lack of permission.

3. Safety, Weather & Airspace Restrictions

All flights are subject to:

Weather conditions
FAA airspace rules and authorizations
Temporary Flight Restrictions (TFRs)
On-site safety considerations

Absolute Aerials reserves the right to delay, modify, or cancel flights when safety or legal compliance requires it. Such changes do not constitute breach of contract.

4. Deliverables & Turnaround

Deliverables typically include edited JPEG photographs and/or video files
Files are delivered via Google Drive, email, or Dropbox
Turnaround times are estimates and may vary due to conditions or complexity

5. Portfolio & Promotional Use

Unless otherwise agreed in writing, Absolute Aerials reserves the right to use completed imagery for website portfolio display, marketing, and promotional purposes.

Clients wishing to opt out must notify Absolute Aerials prior to the scheduled shoot.

6. Payment Terms

Payment terms are stated on the invoice
Accepted payment methods include Zelle and Wix-integrated payment options
Late or unpaid invoices may delay delivery of final files

7. Intellectual Property & Licensing

Absolute Aerials retains copyright to all imagery unless otherwise agreed in writing
Clients are granted a license for marketing, listing, and promotional use
Redistribution, resale, or third-party licensing requires written consent

8. Limitation of Liability

To the fullest extent permitted by law, Absolute Aerials shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid for the services provided.

9. Indemnification

Client agrees to indemnify and hold harmless Absolute Aerials from claims arising from unauthorized access, misuse of imagery, or client-provided instructions.

10. Governing Law

These Terms are governed by the laws of the State of Florida.

11. Changes to Terms

Absolute Aerials reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the updated Terms.
